Requirements for a UK Skilled Worker Visa via Self-Sponsorship

To sponsor yourself under the Skilled Worker route, you must satisfy UK Visas and Immigration that:

  • You are aged 18 or over;
  • There is a genuine and active UK company operating lawfully;
  • Your UK company holds a valid Skilled Worker sponsor licence;
  • Your company has assigned you a valid Certificate of Sponsorship (CoS);

Stage 1: Establishing a UK Company

You must either register a new company in the UK or already own an existing UK-registered business.

Registering a UK Company From Overseas

It is possible to register a UK company from outside the UK. Directors are not required to be UK residents or British citizens. However, all directors must meet statutory obligations, and non-resident directors may need to appoint a UK-based representative if they cannot fulfil duties in person.

Stage 2: Applying for a Skilled Worker Sponsor Licence

Once the UK company is established, it must apply for a Skilled Worker sponsor licence. The Home Office must be satisfied that:

  • The business is genuine and operating lawfully in the UK;
  • The business is capable of fulfilling sponsor duties; and
  • The role offered meets the Skilled Worker skill and salary requirements.

Evidence of a Genuine UK Business

The Home Office requires at least four documents listed in Appendix A of the sponsor guidance. For start-up businesses trading for less than 18 months, this typically includes:

Mandatory:
  • Evidence of a UK corporate bank account
Plus three of the following:
  • PAYE and National Insurance registration
  • VAT registration
  • Employer's liability insurance (minimum £5 million)
  • Lease or ownership of business premises
  • Latest annual accounts

Note: A UK business does not need to be actively trading at the time of application, but evidence such as a business plan, investment funds, or early-stage commercial activity can significantly strengthen an application.

Sponsor Duties and HR Systems

Licensed sponsors must comply with strict record-keeping, reporting, and compliance obligations. The Home Office will assess whether the business has appropriate HR systems in place and may conduct compliance visits.

Genuine Employment, Skill Level, and Salary Requirements

The Home Office will assess whether:

  • The role meets the Skilled Worker skill threshold (normally RQF Level 3 or above);
  • The salary meets or exceeds the general threshold and the SOC 2020 going rate;
  • The role is genuine and not created solely for immigration purposes;
  • There is a genuine employer-employee relationship; and
  • The worker will not be supplied to a third party for routine work.

Appointing Key Personnel

Before submitting a sponsor licence application, the business must appoint:

  • An Authorising Officer
  • A Key Contact
  • At least one Level 1 User

Important: For self-sponsorship cases, key personnel must be UK-based, and the Level 1 User must be British or settled. In practice, this requires a trusted UK-based individual with sufficient oversight of the business.

Stage 3: Assigning a Certificate of Sponsorship

Once licensed, the company must assign a Defined Certificate of Sponsorship. The CoS must:

  • Be issued no more than three months before the visa application;
  • Include accurate job, salary, and start-date details; and
  • Confirm that it has not been previously used or withdrawn.

Stage 4: Applying for the Skilled Worker Visa

Following assignment of the CoS, the visa application must confirm compliance with all Skilled Worker requirements, including skill level, salary, English language ability, maintenance funds, and any criminal record or TB certification.

Timing: Applications may be submitted up to three months before the intended start date. Processing times are typically three weeks overseas and eight weeks for in-country applications, subject to priority services.
